First of all our bestow our sincere and heartful thanks to  the  benign Government of Tamil Nadu for the constitution of One Man Committee towards rectification of pay anomalies on Revision of Pay 2017. We the District Revenue Officers (Retd.), warmly welcome the One man committee and its Chairman, as Trust worthy Officer to safeguard our interest.

We humbly, submit our redressable grievances sprout during the Pay Commission Revision 2006 and spread during the Pay Commission Revision 2017 as follows for kind consideration and justifiable recommendation to the Government for rectification of anomalies.

We wish to state that in the G.O 1st cited, the revision of pay scales was fixed to the posts of District Revenue Officer and Joint Directors of Agriculture, Horticulture, Animal Husbandry, Fisheries and Health from Rs.l2000-375- 16000 to the new scale of Pay Rs.15600-39100+ Grade Pay of Rs.7600. on par with the 5 pay commissions already announced by Govt.

The pay scales of the said Joint Directors only upgraded on recommendations of One Man Commission, headed by Thiru. Rajiv Rajan, IAS and fixed to the revised scale of Rs.37400-67000+Grade Pay of Rs.8700 from previous fixation in the Time scale of Rs.Rs.15600-31900+Grade Pay of  Rs.7600 in the G.O. Ms.No.:300 and 448/ Finance (PC) Dept, Dated 26.08.2010 and 31.12.2010 respectively suomoto, But in the upgradation of the pay scale, the category of District Revenue Officer alone was not considered although
proper representations were made saying that Joint Directors were technically qualified persons.
 
On our further representations to the Government in this regard to  upgrade our post to consider and refix the revision of pay scales to Rs.37400- 67000+Grade pay of Rs.8700 as was done in the case of the above said Joint Directors, the Government ordered in their G.0.Ms.No.:71 /Finance (Pay Cell) Dept./ Dated: 26.02.2011, that the pay hike ordered to the above said Joint Directors was down graded to the pay scale of Rs.15600-39100+Grade pay of Rs.7600 by specifically stating in para 6 of the said G.O. that  the  down gradation was done after careful consideration, examining the extra ordinary situation prevailing among the Officers holding identical posts of other departments carrying same pay structure as on 01.01.2006.

Further G.O: Ms.: No.: 242/ Finance (PC) Dept./ Dated 22.07.2013 issued by the Govt. was also not in favour of the said Joint Directors.

Aggrieved by G.O.Ms.No.:71/ Finance (Pay Cell) Dept./ Dated 26.02.2011 and.G.O.Ms.No.:242/ Finance (Pay Cell) Dept./ Dated 22.07.2013, the above said Joint Directors moved the Hon'ble High Court and obtained stay. Therefore right from 31.12.2010, they are getting the enhanced pay scale of Rs.37400-67000+Grade pay of Rs.8700 and the retired Joint Directors of the above departments (the pensioners) are also getting 50% of the said enhanced pay scale as pension.

The writ appeals in W.A.nos 504 of 2012 along with batch of cases filed by the said Joint Directors (appellants) were disposed of on 27.02.2014. The Hon'ble Division Bench of the High Court directed the Government  to  constitute a Pay Grievance Redressal Committee and also ordered that the pay hike of the appellants (Joint Directors) shall continue till orders are  passed afresh by the Government on recommendation of Pay Grievance Redressal Cell to be formed. The Government have gone on appeal (SLP) before the Supreme Court, New Delhi, which are still pending disposal.


We, therefore, submit that the grievance of the District Revenue Officers are still continue even after several representations made earlier before the committees and the Government. Thesaid Joint Directors who were  getting equal basic pay prior to 2006 are still getting enhanced basic pay of RS.37400- 67000+G.P of Rs.8700 siting the court orders.
It is needless to point out that the post of District Revenue Officers is no way inferior to the posts of Joint Directors on the other hand it carries higher responsibilities and coordination in the District Administration upgradation of pay scale to one set of officers leaving a single eategory (District Revenue Officers) of officers who were all in the same scale of pay prior to 2006. Therefore, the Pay Commission is not justifiable in fixation of  pay scale to District Revenue Officers. Government ought to have considered this at the time of refixation as proper representations were made by the District Revenue Officers at appropriate times. The chance of rectification at the Pay Commission 2017 was not availed of by Government duly citing the W.Ps and W.As. pending before the courts.
 
The Government in their G.O.Ms.No.:200/ Finance (Pay Cell) Dept./ Dated 10.07.2015 have issued orders that the requests already made by the pay affected officers on anomalies caused in the pay revision 2006 will be taken up for examination at the time of giving effect of 7th Pay Commission by Constituting Commission.

We have also submitted our pathetic representations before the Chairman of the Official Committee constituted for 7th Pay Commission as per the G.O.Ms.No.:40/ Finance (Pay Cell) Dept./ Dated 22.02.2017 to get redressal on our issues. But without considering our grievances, the Government have issued orders in G.O.Ms.No.:303/ Finance (Pay Cell) Dept./ Dated 11.10.2017.

Therefore, the pay scale of the District Revenue Officers have been fixed as per the Pay Commission 2017 by taking into account of the low pay scale of Rs.15600-31900+GP Rs.7600. Whereas, our equal Cadre officers i.e. Joint


Directors of the said departments have been directed to opt for their fixation of pay either to get continuing the existing hike pay of Pay Revision 2006 or to fix the new pay on the hike pay under 7th pay commission as per G.O.Ms.No.:328/ Finance (Pay Cell) Dept./ Dated 31.07.2017.

The Pensioners of the above Joint Directorsalso continue to get 50%  of the enhanced pay fixedunder 7th pay commission.

Only because of the said Joint Directors moved the Court, they are still allowed to get pay hike both under 6th and 7th Pay Commissions. But, we the District Revenue Officers equal cadres of the said Joint Directors are still getting very low pay scales for the past 10 years (50% lesser).As it is quite contrary to the natural Justice, we, the officers in the state of despondency, humbly and sincerely request the benign One Man Committee to consider our above said grievances sympathetically and recommend the Government to refix our pay scales of Rs.37400-67000+G.P of Rs.8700 on par with the pay scales of the said Joint Directors and then order to fix the pay as per 7* Pay Commission.
 
Further we wish to bring to the kind noticeof  theOne Man Committee  that the error / mistake occurred in the fixation of the review pay for the District reve officer is in service and pre retire of 2016. During the 7th pay commission announced in GO No 303 Finance ( Paycell)Dept dated. 11.10.2017.

While implementing the recommendation of seventh central pay commission and the official committee – 2017 on revision of pay by the central and state governments the revised pay of  the  central government employees in the cadre of District Revenue officers) and the District Revenue officers have been fixed @ Rs.78,800 /- and Rs.61,900/- Respectively as follows:-

The Central Govt have rightly fixed the revised pay of the Central Government employees of Rs.78800/- by taking in to account the minimum pay ason 01.01.2006 is Rs.29500/- ( Instead of Rs.29920/- Difference is only  meager  one) whereas the Tamilnadu government has fixed the review pay of the District Revenue Officer @ Rs 61900/- intentionally takes into account the minimum  pay as on 1.1.2006 as Rs 23200/- instead of Rs.29920/- Hence  the revised pay  of the District Revenue Officers @ Rs.61,900/- intentionally likeup into account the minimum pay as on 01.01.2006 as Rs.23200/- instead of Rs.29920/-

Hence the revises pay of the District Revenue Officer should have been fixed at Rs,78000/- instead of Rs.61900/- on par with the  central  govt employees (in the Cadre of District Revenue Officer)

To support our claim, the government in its letter No.5047/A/PC-2/2018- 1 Finance (pay cell) Dept dated 01.03.2018 has informed that the initial pay (or) minimum pay of scale pay band 3 – in the pre – revisefd scale of Rs. 12000 – 375-16500/- is Rs. 29920/- So we deserves for this claim.
 
We therefore request that based on the above the minimum pay of the District Revenue Officer as on 01.01.2006 was actually Rs.29920/- & not Rs.23200/- as adopted by the Tamilnadu Government for fixing the pay of the District Revenue officers as on 01.01.2016 and render justice and fix the revised pay of the District Revenue Officers @ Rs.78800/- (Minimum pay as on 01.01.2006 Rs.29920/- x Rs 2.6 7 times = Rs.78000/- W.e.f. 01.01.2016 on par with the central govt employees.
If order is passed on such line explined above we the the Retired District Renewal Officer may get remedy by getting up enhanced pension, on the hike pay.
Further, the Tamilnadu Government in his GO M.S. No.313 Finance (Pay cell) Department dt.25.10.2017 revised pension to their pensioners  by raising2.57 times of their pension drawn last but not following pay  matrix system adapter for their serving government employees. The Central Govt has also fixed Revised Scale of Pay by adoptedpaymatrix for both serving and retiring employees, taken into account the pay drawn from 01.01.1986 to 31.12.1995, 01.01.1996 to 31.12.2005, 01.01.2006 to 31.12.2015 and Corresponding pay as on 01.01.2016 for there employees.
  
So we request the Secretary may kindly look into this anamoly  in  between serving employees pensioners and fix the pension for pensioners by adopting pay matrix system, as done in the Central by commission (Vide Govt  of India letter F.No 38/37/2016 P&PW(A) Ministry of personal  P.G& Pensioners Department of Pension & Pensioners welfare New Delhi) TAHSILDARS: The Tasildars in Revenue Dept& Section Officer in the Secretriat of Government of Tamilnadu are equal stateof officers & drawing equal pay scale of Rs. 6500 – 200 – 10500 as per GOMS No 162/Finance (Pay cell) Dept dt.13.04.1998. But now the difference of pay of Rs.18,400/- is now prevailing in between Tahsildars& Section Officer as per new 7thpay commission we request this may also considered & pass orders. (Statement enclosed in AnnexureI) for reference.
 
A comparative statement of minimum pay fixation as on 01.01.2006 and as on 01.01.2016 for the posts in Revenue Department Dy-Tahsildar, Tahsildar Deputy Collector and District Revenue Officers inTamilnadu Revenue subordinate of service and civil service and distinctly furnished in (Annex II)  and civil service are distinctly furnished in (Annexure IIand III) for one Man Committees perusal for appropriate orders.
OTHER ALLOWANCES :-
Further we request the One Man Committee to recommend to the government of Tamilnadu to sanction 7th Pay Commission arrears of pay and allowances for the period from 01.01.2016 to 30.09.2017 (for 21 months ) for their employees and pensioners, as granted by the Central Government.

We request the one man committee to recommend to  Government  to grant the Medical Allowances from Rs.300 to Rs.1000 for their employees and pensioners, as granted by the Central Government.

Finally we request our esteemed Chairman, OMC &  Secretary  may kindly look into above anomalies explained above of the 7th pay commission &render justice to the Tamilnadu Employees and Pensioners.We pray early orders.

  1. 6) The promotional hierarchy varies (generalist category) from department to department as a result of which several officers are forced to retire with less promotion even after put in 30 / 35 years plus service in (Group-A/B) without reaching Super-Time Scale in whole of their career. On the other hand, their counterparts from the common entry succeed in getting early promotions well within 25 years to reach Super Time Scale. A Welfare Government should ensure that every section of officials and employees working in the government sector should have the satisfaction of getting his or her due in time, both in terms of promotion as well as in terms of pay benefits, without any real or perceived discrimination. A rough random analysis reveals that there are anomalies between erstwhile PB3 & PB4 posts in Tamil Nadu State, (In GOI the difference is much less as they have prescribed minimum service, higher educational qualification, Training, Tests etc. in each category to get promotion) In the case of IAS for Regular Recruit (RR) are initially appointed to Junior Time Scale (JTS), subsequently Senior Scale (SS), Junior Administrative Grade (JAG), Selection Grade (SG), Super Timescale (ST) HAG & Chief Secretary cadre (CS) respectively prescribing minimum service one has to put in each cadre. If we look at the Statement-1, in Tamil Nadu Secretariat many individuals reached erstwhile PB4 category of posts well within a short span of time from PB3 cadre while those who have rendered 30 or 35 years plus service could not reach PB4 and retired only as Section Officer, Under Secretary or Dy. Secretary thus depriving huge financial loss for no fault of theirs. A thorough in-depth study needed between Dy. Secretary, Joint Secretary & Additional Secretary Posts (Non-IAS) notionally from 1-1-2006, and Entry pay from 1-1-2016.
